Terms of Sale for Vouchers

PLEASE READ THESE TERMS AND CONDITIONS (THE "TERMS AND CONDITIONS") OF USE CAREFULLY. BY USING THIS WEBSITE, YOU AGREE TO ABIDE BY THESE TERMS AND CONDITIONS, WHICH WILL CONSTITUTE OUR AGREEMENT (“AGREEMENT”).

THIS AGREEMENT WAS LAST UPDATED ON SEPTEMBER 8, 2022. WE MAY AMEND THIS AGREEMENT FROM TIME TO TIME WITH REASONABLE NOTICE TO YOU, INCLUDING WITHOUT LIMITATION BY POSTING REVISED TERMS ONLINE.

Welcome to Travelzoo^® (the "Site"), provided by Travelzoo (Europe) Ltd (Company Registration #05442657, VAT #863 2710 29) ("Travelzoo"), located at 151 Shaftesbury Avenue, London WC2H 8AL and a wholly owned subsidiary of Travelzoo. Please also read our Privacy Policy and Terms of Service.

Travelzoo Local Deals and Getaways

Travelzoo provides Travelzoo users the opportunity to purchase vouchers (“Vouchers”) for local merchants (“Merchants” or the “Merchant”), such as spas, restaurants and activities ("Local Deals") or hotels (“Getaways”) with a time-limited promotional value-add or discount.

By placing an order to buy a Local Deal or Getaway, you are agreeing to make an offer to buy the Local Deal or Getaway you have selected, subject to the terms and conditions associated with that Local Deal or Getaway offered by the Merchant. If your order for a Voucher is accepted by Travelzoo, you will receive an email to indicate that your order for the Voucher has been placed and accepted. Your credit card or account of your preferred payment method will not be charged until your order is accepted, in which case your credit card or account will be charged for the amount of your order and you will be emailed the Voucher for the Local Deal or Getaway.

Voucher

By purchasing and printing or accessing a Voucher from Travelzoo (the "Site"), or any other website associated with Travelzoo, you agree to the additional terms and conditions ("Terms of Sale") as provided hereafter. If you do not agree to the Site's Terms of Sale or Terms of Service, you should refrain from using the Site.

All Vouchers printed from or accessed through the Site are promotional vouchers that are issued in connection with a promotional program and may be purchased from participating Merchants through the Site to be used in exchange for services or goods. By placing an order for a Voucher from a Merchant through the Site, you make an offer to purchase the Voucher(s) you have selected on the following terms and conditions. You are required to, at a minimum, provide your name, email address and payment information in order to purchase and print or access any Voucher. If you create a profile with Travelzoo through the Site, this will provide you with easy access to print your orders, view your past purchases, modify your preferences, and to ensure permissible use of the Voucher. The Voucher you purchase through the Site is redeemable for services or goods by the Merchant. The Merchant, not Travelzoo, is the issuer of the Voucher and the seller of the specified goods and is solely responsible for redeeming any Voucher you purchase. The applicable refund policy is set forth in the terms and conditions on your Voucher (the “Voucher Terms”). The price listed on the Voucher will be inclusive of VAT. The Merchant shall be responsible for accounting for VAT on the purchase price of the Voucher. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold.

Cancellation and refunds

The applicable refund policy is set forth in the Voucher Terms.

If you pay the surcharge to make your purchase Fully Refundable, the terms set out in section 4 shall apply.

Vouchers for date specific events are typically not eligible for a refund. For all other Voucher products, you have a statutory right to cancel your purchase within 14 days after you receive your Voucher by email, provided you have not already redeemed your Voucher. In case you have already made a booking or reserved a stay with a Merchant, the refundability of the Voucher is subject to the Merchant’s cancellation policy. The amount of the refund will be the price paid for the Voucher in the currency set forth on the applicable website site edition where the Voucher was purchased and on the face of the Voucher after purchase. Any refunds will be made solely in compliance with the applicable refund policy and in the same currency as purchase. Travelzoo is not liable for any currency exchange rate risk and is not responsible for covering any fluctuations in currency.

To exercise the right to cancel your purchase, you must use the self-refund option, available in the “My Account” section of the Travelzoo website or inform us of your decision to cancel the purchase of the Voucher by sending your request to the email address support_uk@travelzoo.com. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. You may use the below model cancellation form but it is not obligatory.

For fully refundable Vouchers, including Vouchers purchased with the Fully Refundable surcharge (defined below), refund requests will be honoured by Travelzoo on behalf of the Merchant for the base value of the Voucher through the expiration date of the Voucher (as set forth on the Voucher). Travelzoo can only issue refunds to the original card holder’s credit card or to the account of the payment method that was originally used for the purchase. If you cancel your purchase of Voucher(s), we will reimburse to you the amount you paid for such Voucher(s). Reimbursement of the amount paid for the Fully Refundable surcharge is described in more detail below. After the cancellation of your purchase, you must destroy the Voucher and delete any emails sent to you with a copy of the Voucher. If you fail to comply with this obligation and/or attempt to use a cancelled Voucher, we may have a right of action against you for compensation.

1) Specific Terms and Conditions for Restaurant Vouchers

"Restaurant" hereafter shall be defined as a Merchant who offers food and beverage for sale in its regular business operations and is making such food and beverages available to purchasers of Vouchers. These Specific Terms and Conditions for Restaurant Vouchers are in addition to the Voucher Terms. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold.

• The use of Vouchers at Restaurants for alcoholic beverages is at the sole discretion of the Merchant and is subject to compliance with applicable law.
• The Site’s Vouchers cannot be combined with any other vouchers, third party certificates, coupons, or promotions, unless otherwise specified and accepted by the Restaurant.
• Restaurant Vouchers cannot be used for tips or prior balances, unless permitted by the Restaurant.
• Restaurant Vouchers are not valid for takeaway and are for dine-in only, unless otherwise stated by the Restaurant on the Voucher.
• Frequency of redemption is determined by the Restaurants and shall be contained in the Voucher offer on the Site.
• The issuing of restaurant credit is at the sole discretion of the Restaurant unless otherwise required by applicable law.
• Neither Travelzoo nor the Restaurant is responsible for lost or stolen Vouchers or Restaurant Voucher reference numbers.
• Reproduction, sale or trade of a Restaurant Voucher is prohibited unless done so in compliance with applicable law.
• Any attempted redemption not consistent with the Voucher Terms or this Agreement will render the Restaurant Voucher void.
• Vouchers must be redeemed in full on a one-time basis only and may not be redeemed incrementally. If a Voucher is redeemed at less than its face value, there shall be no entitlement to a credit or to a new Voucher equal to the difference between the face value and the amount redeemed.
• You must redeem your Voucher before the expiry date specified on the Voucher or subsequently communicated to you. After the expiry date, the Voucher is void, according to applicable law. No refunds will be issued for expired Vouchers.
• All purchases of Vouchers for Restaurants may have statutory limitations on the amount of the Voucher value that can be redeemed for alcoholic beverages. Compliance with applicable law is the responsibility of the Merchant.
• Travelzoo's sole role in the transaction is as a marketing agent for the Restaurant Voucher, and the applicability and compliance with any relevant law is solely determined and consummated by the Merchant, and Travelzoo has no role in such determination or action on the part of the Merchant.

2) Specific Terms and Conditions for All Other Merchant Vouchers

"All Other Merchants" includes, but is not limited to, hotels, spas, and activities. These Specific Terms and Conditions for All Other Merchant Vouchers are in addition to the Voucher Terms. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold.

• Unless otherwise specified on the Voucher or by the Merchant, there is a limit one (1) Voucher per redemption.
• The issuing of credit is at the sole discretion of the Merchant unless otherwise required by law.
• Refundability of the Voucher is subject to the Merchant’s cancellation policy and to this Agreement. If you purchase a Voucher for a hotel and reserve a stay, you must first cancel with the Merchant in compliance with their cancellation policy before you apply for a refund through Travelzoo (prior to the expiry date).
• You must redeem your Voucher before the expiry date specified on the Voucher or subsequently communicated to you. After the expiry date, the Voucher is void, according to applicable law. No refunds will be issued for expired Vouchers.
• The price of your Voucher includes VAT but does not include gratuities.
• The rate of discount offered on the Voucher applies only to the goods and services offered on the Voucher; this is not a rate at which other goods and services will be discounted by the Merchant.
• Vouchers cannot be used for tips or prior balances, unless permitted by the Merchant.
• The Site's Vouchers cannot be combined with any other vouchers, third party certificates, coupons, or promotions, unless otherwise specified and accepted by the Merchant.
• Neither Travelzoo nor the Merchant is responsible for lost or stolen Vouchers or Voucher reference numbers. Please log into your account to see your Vouchers.
• Reproduction, sale or trade of a Voucher is prohibited unless done so in compliance with applicable law.
• Vouchers must be redeemed in full on a one-time basis only and may not be redeemed incrementally. If a Voucher is redeemed at less than its face value, there shall be no entitlement to a credit or to a new Voucher equal to the difference between the face value and the amount redeemed.
• Any attempted redemption not consistent with the Voucher Terms or this Agreement will render the Voucher void.

3) Additional Terms and Conditions for All Vouchers

All Vouchers shall be subject to this Agreement, the Voucher Terms and any additional terms and conditions of Travelzoo and the participating Merchant. The Merchant is the seller of the goods or services which you are purchasing.

The holder and issuer of a Voucher is the Merchant. As a holder and issuer of the Voucher, the Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Merchant. You waive, and release Travelzoo and its officers, directors, employees and agents from, any claim, liabilities, damages, or injury arising from or related to any act or omission of Merchant in connection with a Voucher or the services/goods provided in connection therewith and/or as it relates to compliance with applicable unclaimed property and other laws relating to the redemption of the Vouchers or any portion thereof.

4. Additional terms applicable if you purchase the Fully Refundable option (not available for all Vouchers)

If you pay the surcharge to make your purchase fully refundable (“Fully Refundable”), the below terms will apply to all Vouchers purchased in combination with the surcharge. The Fully Refundable surcharge itself is refundable for 14 days from the time of purchase, except that the surcharge can no longer be refunded once the Voucher(s) purchased in combination with the surcharge has (have) been redeemed. If you request a refund pursuant to the terms of the “Cancellation and Refunds” section above within 14 days from the time of purchase, you will be refunded both the amount of the surcharge and the amounts paid for all unredeemed Voucher(s) purchased in connection with the surcharge. After 14 days, the amount paid for the surcharge is non-refundable. If you have selected and purchased the surcharge and have not redeemed any Voucher(s) purchased in connection with the surcharge, and you request a refund pursuant to the terms of the “Cancellation and Refunds” section above after 14 days from the time of purchase, you can refund any individual unredeemed Voucher but you will not be refunded the amount of the surcharge. In case you have already made a booking or reserved a stay with the Merchant, you must first cancel with the Merchant in compliance with the Merchant’s cancellation policy prior to refunding through Travelzoo. If you cancel or change your booking at a time later than allowed under the Merchant’s cancellation policy, you may be subject to additional fees or voucher forfeiture, even if you have paid for the surcharge. The Fully Refundable option only applies to the Vouchers bought in connection with the Fully Refundable surcharge and does not apply to previously or subsequently purchased Vouchers.

Applicable Law

This Agreement and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims). The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction – in particular, if you are using the services or goods as a consumer.

Severability

If any provision of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. In the event that any provision of this Agreement is struck out in such manner, the liability of Travelzoo in respect of Vouchers shall be excluded to the fullest extent permitted by law.
