Customer Ratings and Reviews Terms and Conditions

These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Travelzoo ("Travelzoo"). By submitting a rating or review to Travelzoo (whether through a Travelzoo website or through a Travelzoo Facebook page or Twitter page), you agree to be bound by these terms and conditions. Please read these terms and conditions carefully. To the extent of any conflict between Travelzoo’s Privacy Policy, located at https://www.travelzoo.com/privacy/and these Terms of Use, these Terms of Use shall control with respect to customer ratings and reviews.

By submitting any content to Travelzoo, you represent and warrant that:

• You are the sole author and owner of the content and any intellectual property rights thereto;
• That your comments constitute your personal opinion based on your first-hand experience;
• All "moral rights" that you may have in such content have been voluntarily waived by you;
• All content that you supply is true, accurate, current and complete;
• You are at least 18 years of age or older;
• Use of the content you supply does not violate these Terms of Use and will not cause injury to any person, entity or third party; and
• That you have no affiliation with the place you are rating or reviewing (including, but not limited to, that neither you nor any family member of yours was or is employed at such place).

You further agree and warrant that you shall not submit any content:

• That is known by you to be false, inaccurate or misleading;
• That infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• That violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• That refers to private information of any third party, including without limitation, surname (family name), addresses, phone numbers, email addresses, Social Security numbers and credit card numbers, or otherwise violates the rights of any third party, including without limitation, privacy rights;
• That is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or harassing to any individual, merchant, partnership or corporation;
• For which you were compensated or granted any consideration by any person or third party;
• That includes any information that references other websites or addresses, email addresses, contact information or phone numbers; and
• That contains any computer viruses, worms or other potentially damaging computer programs or files.

Travelzoo takes no responsibility and assumes no liability for any content displayed publicly or for any loss or damage thereto, nor is Travelzoo liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity. You agree you will be solely responsible for the content of any comments you make. You shall be solely liable for any damages resulting from any violation of the restrictions included herein or any harm resulting from your submission.

You agree to indemnify and hold harmless Travelzoo (and its affiliates, officers, directors, agents, subsidiaries, joint ventures, employees and any third-party service provider) from any and all claims, demands, losses, costs and expenses (including reasonable attorneys' fees), liabilities, fines, penalties or damages (actual and consequential) of every kind and nature, known and unknown, arising out of a breach of your representations and warranties set forth above or your violation of any law or the rights of a third party.

For any content that you submit (including, but not limited to, any reviews, questions, comments, suggestions, ideas, stories or any information contained in any submission), please be aware that you grant Travelzoo and its affiliates a perpetual, irrevocable, non-exclusive, royalty-free, transferable and fully sublicesable right and license to use, reproduce, copy, modify, delete in its entirety, adapt, publish, distribute, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world (in any media) for any purpose whatsoever without any compensation to you. You also agree that Travelzoo may use and display publicly on its website and elsewhere the name, city, hometown and state that you submit in connection with your rating and/or review. For the avoidance of doubt, you agree that any submission is non-confidential and non-proprietary and may be used in any manner or medium whatsoever by Travelzoo.

All content that you submit may be used at Travelzoo’s sole discretion. You understand that Travelzoo will have the right (but under no circumstances will Travelzoo have any obligation) to screen, edit, modify, delete, refuse to post or remove any content, in whole or in part, from any portion of Travelzoo’s website, in its sole discretion for any reason whatsoever, including, but not limited to, content that violates these terms and conditions or is otherwise objectionable. Travelzoo does not guarantee that you will have any recourse through Travelzoo.com to edit or delete any content you have submitted. Travelzoo reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Travelzoo, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Travelzoo, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees. You agree that you have no objection to the publication, use, modification, deletion and exploitation of any submitted content by Travelzoo or its licensees, successors and assigns.

Travelzoo may use your email address to contact you about the status of your review and other administrative purposes. Travelzoo may also share your review with our merchants in order that they can address any issues raised in your review. Travelzoo reserves the right at any time, at its sole discretion, to change or otherwise modify these terms and conditions without prior notice, and your continued use of Travelzoo’s website or submission of a rating or review signifies your acceptance of the updated or modified terms.
