THIS AGREEMENT WAS LAST UPDATED ON SEPTEMBER 8, 2022. WE MAY AMEND THIS AGREEMENT FROM TIME TO TIME WITH REASONABLE NOTICE TO YOU, INCLUDING WITHOUT LIMITATION BY POSTING REVISED TERMS ONLINE.
By purchasing and printing a voucher ("Voucher") from Travelzoo (Canada) Inc. (“Travelzoo”), or any other website associated with Travelzoo (the “Site”), you agree to the additional terms and conditions ("Terms of Sale") as provided hereafter. If you do not agree to the Site's Terms of Service or Terms of Sale, you should refrain from using the Site.
All Vouchers printed from the Site are promotional vouchers that are issued in connection with a promotional program, and may be purchased from participating merchants ("Merchants") through the Site to be used in exchange for services or goods. During the designated promotional offer period, the Vouchers will be honored for greater value than their actual cost. By placing an order for a Voucher from a Merchant through the Site, you make an offer to purchase the Vouchers you have selected on the following terms and conditions. You are required to create a profile with Travelzoo in order to purchase and print any Voucher. This will provide you with easy access to print your orders, view your past purchases, modify your preferences, and to ensure permissible use of the Voucher. The Voucher you purchase through the Site is redeemable for services or goods by the Merchant. The Merchant, not Travelzoo, is the issuer of the Voucher and the seller of the specified goods and services and is solely responsible for redeeming any Voucher you purchase. The applicable refund policy is set forth in the terms and conditions of your Voucher (the “Voucher Terms”). Vouchers sold for date specific events are typically not eligible for a refund. For our standard Voucher products, any requests for a refund must be submitted in writing within 14 days of purchase to the email address support_ca@travelzoo.com. For fully refundable Vouchers, including Vouchers purchased with the Fully Refundable surcharge, refund requests will be honored by Travelzoo for the base value of the Voucher (as set forth on the Voucher) through the expiration date of the Voucher (as set forth on the Voucher). Travelzoo can only issue refunds to the original card holder's credit card. The amount of the refund will be the price paid for the Voucher in the currency set forth on the applicable website site edition where the Voucher was purchased and on the face of the Voucher after purchase. Any refunds will be made solely in compliance with the applicable refund policy and in the same currency as purchase. Travelzoo is not liable for any currency exchange rate risk and is not responsible for covering any fluctuations in currency. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold. For additional terms applicable to the Fully Refundable option offered in combination with some Vouchers, please refer to section 4 below.
"Restaurant" hereafter shall be defined as a Merchant who offers food and beverage for sale in its regular business operations, and is making such food and beverages available to purchasers of Vouchers. These Specific Terms and Conditions for Restaurant Vouchers are in addition to the Voucher Terms. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold.
"All Other Merchants" includes, but is not limited to, hotels, spas, and activities. These Specific Terms and Conditions for All Other Merchant Vouchers are in addition to the Voucher Terms. If there is any conflict between this Agreement and the Voucher Terms, the Voucher Terms will hold.
All Vouchers shall be subject to this Agreement, the Voucher Terms and any additional terms and conditions of Travelzoo and the participating Restaurant or Merchant. The Restaurant or Merchant is the seller of the goods or services which you are purchasing.
The holder and issuer of a Restaurant Voucher is the Restaurant. The holder and issuer of a Merchant Voucher is the Merchant. As a holder and issuer of the Voucher, the Restaurant or Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Restaurant or the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers or portions thereof. You waive, and release Travelzoo and its officers, directors, employees and agents from, any claim, liabilities, damages, or injury arising from or related to any act or omission of Restaurant or Merchant in connection with a Voucher or the services/goods provided in connection therewith and/or as it relates to compliance with applicable unclaimed property and other laws relating to the redemption of the Vouchers or any portion thereof. Restaurant Vouchers and Merchant Vouchers are redeemable in their entirety and on a one-time basis only and may not be redeemed incrementally.
According to applicable law, the Merchant may be responsible for allowing you to redeem your Voucher for the cash value based on the money you actually paid for your Voucher (i.e. if you paid $20 for a Voucher which gives you $50 of value to the Merchant, the cash value that you paid is $20, not $50), for a period of time that extends beyond the expiration date on the Voucher. While the expiration date on the Voucher dictates the last date that you can use your Voucher at Merchant for the promotional offer stated on the Travelzoo, applicable law may provide that the Merchant is responsible for honoring the cash value that you paid for your Voucher for a period of time beyond the expiration date stated on the Voucher. In other words, you should be allowed to redeem the cash value (or purchase price) of your Voucher up until the greater of: (1) the Voucher’s expiration date; or (2) the minimum length of time allowed by applicable law for a Voucher to expire. In the event that you have an expired Voucher and would like to redeem it for the price you paid to acquire it, please contact the Merchant. Once again, the Merchant should allow such redemption if applicable law requires it, and we have instructed the Merchant to do so.
Members are restricted from purchasing Vouchers for a total purchase price of more than $10,000 in a single day. By way of examples, this means that if a particular Voucher is priced at $2,000, you cannot purchase more than five (5) of this particular Voucher in a single day; and if a particular Voucher is priced at $10,000, you cannot purchase more than one (1) of this particular Voucher in a single day
By using this Site and printing a Voucher, you agree that:

Purchase, redemption and use of the Vouchers may also be subject to other local, provincial, national, or international laws. You are responsible for compliance with local applicable laws. If you pay the surcharge to make your purchase fully refundable (“Fully Refundable”), the below terms will apply to all Vouchers purchased in combination with the surcharge. The Fully Refundable surcharge itself is refundable for 14 days from the time of purchase, except that the surcharge can no longer be refunded once the Voucher(s) purchased in combination with the surcharge has (have) been redeemed. If you request a refund pursuant to the terms of the “Cancellation and Refunds” section above within 14 days from the time of purchase, you will be refunded both the amount of the surcharge and the amounts paid for all unredeemed Voucher(s) purchased in connection with the surcharge. After 14 days, the amount paid for the surcharge is non-refundable. If you have selected and purchased the surcharge and have not redeemed any Voucher(s) purchased in connection with the surcharge, and you request a refund pursuant to the terms of the “Cancellation and Refunds” section above after 14 days from the time of purchase, you can refund any individual unredeemed Voucher but you will not be refunded the amount of the surcharge. After 14 days, the surcharge is non-refundable. At any time before the Voucher’s expiration date, you can cancel and obtain the refund of all Vouchers purchased by you in combination with the Fully Refundable surcharge that have not been redeemed at the time of such cancellation. Note that the Fully Refundable option can only be used one time and only to cancel and refund all Vouchers bought in connection with the Fully Refundable surcharge that have not yet been redeemed at the time of the use of Fully Refundable option. In case you have already made a booking or reserved a stay with the Merchant, you must first cancel with the Merchant in compliance with the Merchant’s cancellation policy prior to refunding through Travelzoo. If you cancel or change your booking at a time later than allowed under the Merchant’s cancellation policy, you may be subject to additional fees or voucher forfeiture, even if you have paid for the surcharge. The Fully Refundable option does only apply to the Vouchers bought in connection with the Fully Refundable surcharge and does not apply to previously or subsequently purchased Vouchers.
This Agreement and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Ontario. You agree that the courts of Province of Ontario shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims). The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction – in particular, if you are using the services or goods as a consumer.
If any provision of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. In the event that any provision of this Agreement is struck out in such manner, the liability of Travelzoo in respect of Vouchers shall be excluded to the fullest extent permitted by law.
