PLEASE READ THESE TERMS AND CONDITIONS (THE "TERMS AND CONDITIONS") OF USE CAREFULLY. BY USING THIS WEBSITE AND PURCHASING VOUCHERS FOR OFFERS, YOU AGREE TO THESE TERMS AND CONDITIONS.

Welcome to Travelzoo® (the "Site"), provided by Travelzoo (Asia) Limited ("Travelzoo"), located at Unit 3608, AIA Tower, 183 Electric Road, Hong Kong. Please also read our Privacy Statement & Policy and Terms of Use.

Travelzoo Local Deals

Travelzoo provides Travelzoo users the opportunity to purchase products and experiences (a "Local Deal") with a time limited promotional value-add from third party merchants ("Merchants" or the "Merchant").

By placing an order to buy a Local Deal, you are agreeing to make an offer to buy the Local Deal you have selected, subject to the terms and conditions associated with that Local Deal, offered by the Merchant. Each Local Deal must receive a certain number of orders from a collective group of Travelzoo users before the Local Deal becomes available. Once the Local Deal becomes available, you will receive an email to indicate that the Local Deal you have ordered is now active and your order has been placed. Your credit card will not be charged until the Local Deal becomes available. At the time the Local Deal becomes available, your credit card will be charged for the amount of your order and you will be emailed the Voucher (defined below), for the Local Deal.

Voucher

By purchasing and printing a voucher ("Voucher") from the website www.travelzoo.com.ap or any other website associated with Travelzoo (the "Site"), you agree to the additional terms and conditions ("Terms of Sale") as provided hereafter. If you do not agree to the Site's Terms of Sale, Privacy Statement & Policy or Terms of Use, you should refrain from using the Site. Your use of the Site is subject to only these terms, and to no other terms whatsoever.

All Vouchers printed from the Site are promotional vouchers that may be purchased from participating Merchants through the Site to be used in exchange for services or goods often at a discount from their actual cost. By placing an order for a Voucher from a Merchant through the Site, you make an offer to purchase the Voucher(s) you have selected on the proceeding terms and conditions. You are required to create an account in order to purchase and print any Voucher. This will provide you with easy access to print your orders, view your past purchases, modify your preferences, and to ensure permissible use of the Voucher. Your purchase is made directly with the Merchant via the Site and these Terms of Sale and any terms and conditions of the participating Merchant as indicated on the Voucher, form the terms of a contract between Merchant and you. The Merchant is the seller of the Voucher and products and services offered in the Voucher. The Merchant is solely responsible for providing you with the products and services offered in the Voucher, and solely responsible for fulfilling the products and services stated in the Voucher. All queries in respect of the Voucher and/or the goods and services represented by the Voucher must be directed to the applicable Merchant.

Terms and Conditions of Vouchers

• By making a purchase you acknowledge that the purchase is made subject to these Terms and Conditions.
• Once a purchase is made, your credit card will be charged and there is no refund.
• In the case of restaurants, spas and cruises, where reservations are typically required, you need to call the Merchant to book your reservation in advance - the contact information is provided on the Voucher. Please call as soon as possible to secure the dates and times you prefer.
• You must redeem the Voucher before the expiry date specified on the Voucher. After the expiry date, the Voucher is voided and may no longer be redeemed, except in cases required by law or where agreed by the Merchant in circumstances where an unreasonable detriment would be caused.
• The price of the Voucher includes GST.
• The rate of discount offered on the Voucher applies only to the goods and services offered on the Voucher; this is not a rate at which other goods and services will be discounted by the Merchant.
• Vouchers cannot be used for any other purpose or applied to other purchases from the Merchant, unless permitted by the Merchant.
• Vouchers are only redeemable for the goods and services precisely specified on the Voucher. All additional costs not expressly stated, but which may be incurred in use of the Voucher, are your responsibility. Such additional costs include, but are not limited to, meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from departure or activity point, other transfers, taxes including arrival and departure taxes (if applicable), insurance, travel insurance, passports and visas (if applicable).
• It is a condition of use of the Voucher that you may be required to sign a legal release or releases in a form determined by Travelzoo or the Merchant in their absolute discretion.
• Some services for which Vouchers can be redeemed may be dangerous activities, which may result in injury or death, and you participate in these activities at your own risk. Travelzoo takes no responsibility for a service or activity being offered in the Voucher and you take responsibility for your own actions in utilising a service for which the Voucher can be redeemed. No compensation will be payable by Travelzoo if you are unable to use any element of the Voucher as stated due to refusal of participation in certain activities for health, age, behaviour or safety reasons.
• The use of Vouchers at restaurants or bars for alcoholic beverages is at the sole discretion of the Merchant and is subject to compliance with applicable law.
• The Site's Vouchers cannot be combined with any other vouchers, third party certificates, coupons, or promotions, unless otherwise specified and accepted by the Merchant.
• Restaurant Vouchers are not valid for take-out and are for dine in only, unless otherwise stated by the restaurant on the Voucher.
• Frequency of redemption is determined by the Merchant, details of which shall be contained in the Voucher offer on the Site.
• The issuing of a credit is at the sole discretion of the Merchant unless otherwise required by applicable law. Travelzoo does not make any credits or refunds unless notified in accordance with these Terms and Conditions of Vouchers.
• Neither Travelzoo nor the Merchant is responsible for lost or stolen Vouchers or Voucher reference numbers. Please log into your account to see your Vouchers.
• The Vouchers are issued with limited title. It is a condition of issue of Vouchers that they are not reproduced, sold, traded or transferred except with the approval of the Merchant. Transfer without payment of the Voucher to a friend or family member will be permitted where you are unable to reasonably redeem the Voucher before the Voucher expiry date or the Voucher is being given as a gift.
• Vouchers must be redeemed in full on a one-time basis only and may not be redeemed incrementally. If the Voucher is redeemed at less than its face value, there shall be no entitlement to a credit nor to a new Voucher equal to the difference between the face value and the amount redeemed.
• Any attempted redemption or use not consistent with the terms & conditions of the Voucher will render the Voucher void.
• None of your statuary rights as a consumer are affected by these Terms and Conditions of Vouchers.

All Vouchers shall be subject to these Terms and Conditions and the terms and conditions of the participating Merchant as indicated on the Voucher. The Merchant alone (and not Travelzoo) is the seller of the goods or services which you are purchasing.

The holder and issuer of the Voucher is the Merchant. As a holder and issuer of the Voucher, the Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of you, caused in whole or in part by the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers or portions thereof. You waive, and release Travelzoo and its officers, directors, employees and agents from, any loss (including, without limitation, indirect or consequential loss), claim, liabilities, damages, injury or death suffered or sustained (including but not limited to that arising from any person's negligence) from or related to any act or omission of the Merchant in connection with the Voucher or the services/goods provided in connection therewith, except any liability that cannot be excluded by law (in which case that liability is limited to the face value of the relevant Voucher). Travelzoo will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Voucher if the deficiency is occasioned by any cause outside the reasonable control of Travelzoo, including but without limitation technical malfunctions or failures. Travelzoo are not liable or responsible if the Voucher cannot be emailed to you, for example, because it is blocked by a firewall or filter, or because you have provided Travelzoo with an incorrect email address or you have changed your email address without notifying Travelzoo.

Applicable Law

These Terms of Sale and any terms and conditions of the participating Merchant as indicated on the Voucher are governed by the laws of Singapore. Each of the parties irrevocably submits to the non-exclusive jurisdiction of the courts of Singapore.

Severability

If any provision of these Terms and Conditions or any terms and conditions of the participating Merchant as indicated on the Voucher shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions. In the event that any provision of these terms and conditions is struck out in such manner, the liability of Travelzoo in respect of Local Deals and Vouchers shall be excluded to the fullest extent permitted by law.
