Travelzoo VIP Program – Terms and Conditions
By applying for or participating in the Travelzoo VIP Program (“Program”), you agree that you have read and understand this Agreement ("Agreement") and agree to be bound by this Agreement. The VIP Program, operated by Travelzoo Inc. (“Travelzoo”), is designed to reward Travelzoo’s loyal subscribers. Enrollment To participate in the Program, you must be invited by Travelzoo via email and click on the link in your e-mail, fill-in the requested information, acknowledge your acceptance of this Agreement, and submit to Travelzoo. Enrollment in the Program is FREE. Travelzoo reserves the right to change the Program, introduce new VIP programs, or introduce a membership fee at any time. Travelzoo will notify all Program participants of changes or Program revisions prior to inception or change. Eligibility The Program is only open to individuals who are residents of United States and who are above the age of majority in the jurisdiction where they reside. Participants in the Program may sign up for only one (1) Program account. Participation To take advantage of travel deals advertised to Program participants, you must provide your Program username/account number/email address. VIP status may be revoked by Travelzoo, in its sole discretion, at any time, for reasons including but not limited to inactivity of the Program participant’s account or lack of activity on the Travelzoo website. If any rewards are in the Program participant’s VIP account at the time of revocation, such rewards will expire and be cancelled. Travelzoo reserves the right at any time and without notice to cancel the Program or to substitute rewards for alternatives of comparable value. General Terms See individual travel offers for terms and conditions, including travel restrictions such as blackout dates and occupancy restrictions for all travel offers advertised to Program participants. All travel offers are subject to availability, restricted to the dates outlined on the specific travel offer page, and must be used in the travel period outlined on the specific travel offer page. All hotel offers are limited to the number of nights and occupancy restrictions listed in the travel offer, all airline flight offers are limited to the number and type of airline tickets specified in the travel offer, and all holiday offers are limited to the duration and occupancy requirements specified in the travel offer. THE PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. TRAVELZOO AND ITS RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS AND AGENTS (COLLECTIVELY "PROGRAM PROVIDERS") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PROGRAM PROVIDERS MAKE NO WARRANTY THAT: (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS; (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM YOUR USE OF THE PROGRAM WILL MEET YOUR EXPECTATIONS. PROGRAM PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PROGRAM PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE PROGRAM OR ANY BENEFITS THEREOF; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE THE PROGRAM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR PROGRAM DATA; OR (iv) ANY OTHER MATTER RELATING TO THE PROGRAM. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental, consequential or other damages. Accordingly, some of the above limitations and exclusions may not apply to you. Sponsor reserves the right to cancel or modify the Program at any time. You understand and acknowledge that any material downloaded or otherwise obtained through the use of the Program is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. Travelzoo is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from downloading any material from Travelzoo’s website, regardless of whether the material was prepared by Sponsor or a third party, and regardless of whether the material is connected to Sponsor’s website by a hypertext link. You agree to indemnify and hold harmless Travelzoo from any claim, action, demand, loss or damages (including attorneys' fees) made or incurred by any third party arising out of or relating to your conduct, your violation of this Agreement, or your violation of any rights of a third party in connection with your participation in the Program. Governing Law This Agreement is governed and interpreted by the laws of New York, without regard to its conflict of law provisions. Privacy In connection with the Program, Travelzoo will collect and use personal information submitted by Program participants. By participating in the Program, Program participants hereby agree to the management of their personal information, as explained in Travelzoo's privacy policy.
